1. Purpose

These Terms of Use govern access to and use of the RunMyStartup platform, available at runmystartup.com.

By creating an account or using the service, you accept these Terms without reservation.

2. Service description

RunMyStartup is a SaaS platform providing AI agents that can build, deploy, and operate startup projects on behalf of the user. Agents act under human supervision: every critical action requires user approval.

3. Access and registration

Access to the service requires creating an account. Users must provide accurate information and maintain the confidentiality of their login credentials.

Users must be at least 16 years old to use the service.

5. Subscriptions and payment

RunMyStartup offers several subscription plans (Discovery, Founder, Studio, Scale). Current pricing is displayed on the website's pricing page.

Payments are processed through Stripe. By subscribing to a paid plan, you agree to Stripe's payment terms.

Subscriptions are automatically renewed at each billing cycle (monthly or annually). You can cancel at any time from your account settings. Cancellation takes effect at the end of the current period.

A 3% commission on revenue generated through projects created via the platform applies, as specified in your plan terms.

6. Right of withdrawal

Under Articles L221-18 et seq. of the French Consumer Code, consumers are entitled to a 14-day withdrawal period.

However, pursuant to Article L221-28, 13° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium if performance has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal.

By accepting these Terms and using the service, the user gives express consent to the immediate commencement of the service and acknowledges losing their right of withdrawal.

AI credits consumed are final and non-refundable, as costs are incurred immediately with our providers. In case of withdrawal before the service begins, a full refund is issued within 14 days.

7. Legal guarantee of conformity

In accordance with Articles L224-25-1 to L224-25-32 of the French Consumer Code, the RunMyStartup digital service is subject to the legal guarantee of conformity.

In case of a lack of conformity identified within 2 years from the provision of the service, the user may request that the service be brought into conformity. If this is impossible or disproportionately costly, the user may obtain a price reduction or contract termination.

The publisher is liable for defects of conformity existing at the time of service provision and those appearing within 2 years thereafter.

8. Intellectual property

The RunMyStartup platform, its source code, design, and content are the property of Robin Pluviaux. Users are granted a personal, non-transferable, non-exclusive right to use the service within the scope of their subscription.

Content and projects generated by AI agents on behalf of the user remain the user's property.

9. Liability

RunMyStartup provides the service "as is". The publisher commits to implementing reasonable means to ensure proper service operation, without guarantee of results.

Users may cancel their subscription at any time from their account settings. Cancellation takes effect at the end of the current billing period.

The publisher reserves the right to suspend or delete an account in case of violation of these Terms, after notifying the user except in cases of emergency.

11. Changes to Terms

The publisher reserves the right to modify these Terms. Users will be notified by email of any substantial changes at least 30 days before they take effect. Continued use of the service after that date constitutes acceptance of the new terms.

12. Governing law

These Terms are governed by French law. In case of dispute, the courts of Mulhouse, France shall have exclusive jurisdiction, subject to mandatory consumer protection provisions.
